What can I do if I feel that my worker is treating me unfairly?

        You should file a written complaint. Some examples of unfair treatment follow:

- Your worker is rude or abusive.

- Your worker won't take or return your phone calls.

- Your worker won't answer your questions or tell you about your rights.

How do I file a complaint?

        Write your complaint in a letter to the Commissioner of the Erie County Department of Social Services (DSS). In the letter, state completely the problems you are having with your worker. State any past problems as well.

        Be sure to keep a copy.

What can I do if I don't hear back from the DSS or if I am unhappy with their answer?

        The DSS must acknowledge and investigate your complaint. If you don't hear back or you are unhappy with their answer, you should file a complaint with the Office of Temporary and Disability Assistance (OTDA).

        Be sure to keep a copy of your letter. In your complaint, state again the problems you are having (or had) and why you are unhappy with the answer or lack of answer from the Erie County Department of Social Services.

        The OTDA should investigate and contact the Erie County Department of Social Services.
