If my family breaks up, who gets to keep the Section 8 voucher?

        The Housing Authority decides who may remain in the Section 8 program when a family breaks up.

What does the Housing Authority consider in determining who gets to remain in the program?

        In determining which family member gets to keep the Section 8 voucher, the Housing Authority may consider:

1. Whether there are family members still residing in the unit subsidized by the voucher.

2. Whether there are minor children elderly, disabled, or ill family members.

3. Whether a family member of the household was subjected to physical violence, actual or threatened, by a spouse or other member of the household.

4. Other factors as determined by the Housing Authority

What if there is a divorce or separation decree stating which family member will keep the voucher?

        If a court decree for a divorce or separation states who shall keep the voucher, then the Housing Authority must adhere to the court order.
